Welcome to Luxe & Rest. These Terms of Service ("Terms") govern your access to and use of luxeandrest.co.nz (the "Site"), operated by Luxe & Rest from 417 East Tamaki Road, Auckland 2013, New Zealand. By visiting our Site and/or purchasing something from us, you agree to be bound by these Terms.
1. About us
Luxe & Rest sells premium French flax linen bedding to customers in New Zealand and internationally. Throughout these Terms, "we", "us" and "our" refer to Luxe & Rest. "You" and "your" refer to the customer.
2. Eligibility
By using this Site, you confirm that you are at least 18 years old, or that you are accessing the Site under the supervision of a parent or legal guardian. You may not use our products for any illegal or unauthorised purpose.
3. Products and pricing
All prices on the Site are shown in New Zealand Dollars (NZD) and are inclusive of GST where applicable. We reserve the right to modify product descriptions, prices and availability at any time without notice. We have made every effort to display the colours and textures of our products as accurately as possible; however, we cannot guarantee that your screen will display these accurately.
4. Orders and payment
By placing an order you make an offer to purchase the products at the prices and on the terms shown at checkout. We reserve the right to accept or decline any order. Payment must be made in full at the time of order via the payment methods we offer at checkout. If payment fails or is declined, your order will not be processed.
5. Shipping
Shipping terms, costs and delivery estimates are set out in our Shipping Policy. Title and risk in the products pass to you on delivery.
6. Returns and refunds
Our returns and refunds process is set out in our Return and Refund Policy. Nothing in our policies limits your rights under the New Zealand Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
7. Consumer Guarantees Act
If you are purchasing as a consumer, you have rights under the Consumer Guarantees Act 1993 that cannot be excluded. Our products come with guarantees that cannot be excluded under New Zealand consumer law. If a product is faulty, you may be entitled to a repair, replacement or refund.
8. Intellectual property
All content on this Site — including text, photography, graphics, logos and the "Luxe & Rest" name — is the property of Luxe & Rest or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify or commercially exploit any part of the Site without our prior written permission.
9. Limitation of liability
To the extent permitted by law, Luxe & Rest is not liable for any indirect, incidental, special or consequential losses arising out of your use of the Site or our products. Nothing in these Terms excludes any liability that cannot lawfully be excluded.
10. Privacy
Your personal information is handled in accordance with our Privacy Policy and the New Zealand Privacy Act 2020.
11. Governing law
These Terms are governed by the laws of New Zealand. Any dispute will be subject to the exclusive jurisdiction of the courts of New Zealand.
12. Changes to these Terms
We may update these Terms from time to time. The most current version will always be posted on this page with the "Last updated" date above.
